Martha’s Story: Truck Accident

Martha was a medical transportation driver. One early December morning, she was on her way to pick up her first client of the day to take him to a dialysis appointment. It was dark and foggy with very low visibility. Martha had the right of way as she approached an intersection, but a fully loaded semi-truck pulled out in front of her to make a left turn. She smashed head-on into the semi’s second trailer before it could complete the turn. Martha’s vehicle burst into flames. Fortunately, the semi-driver was able to pull her from the wreckage before the flames consumed her car.

Martha was life-flighted to Harborview, where the doctors learned that her extensive injuries included multiple broken bones in her ribs, arms, leg, and foot. She also suffered a traumatic brain injury (TBI) with vision loss, bruising and serious cuts.

Martha spent a month and a half in Harborview before being discharged to a local rehabilitation facility, where she was admitted as an inpatient for another two and a half months. Martha’s years-long recovery included numerous visits with occupational and physical therapists and a multitude of other specialists. Her ability to walk as well as her vision and memory were permanently impaired as a result of this collision.

The insurance company for the semi-truck believed that Martha was traveling too fast for conditions at the time of the collision. They felt that Martha had caused or significantly contributed to the collision. Church & Page PLLC was able to hire the correct expert to refute this position as well as another expert to help establish the value of Martha’s claim. With this preparation, Church & Page PLLC was able to resolve Martha’s case for a recovery in excess of $1.39 million.
